TRAVEL SERVICE AGREEMENT
This Service Agreement ("Agreement") is entered into between DMC Turquia LLC ("Company"), a Wyoming LLC, and the customer ("Client") purchasing travel services.
1. Scope of Services
The Company acts as a travel facilitator and booking agent. Ground operations, logistics, and vendor networks are executed via exclusive TÜRSAB-certified operational affiliates under strict quality standards. The services provided to the Client may include booking of flights, hotel accommodations, ground transportation, tours, and other luxury travel-related services as specified in the Client’s itinerary.
2. Booking and Payment
Payment Requirement: All bookings are subject to availability and are not confirmed until the Company receives the required deposit (50% for FIT bookings / 30% for Group bookings).
Final Payment Deadline: The final balance must be paid exactly 30 days prior to arrival. For last-minute bookings made within 15 days or fewer of arrival, 100% full payment is required immediately upon confirmation. Last-minute bookings are fully protected with a cash refund or open-date credit guarantee if unfulfilled due to provider failure.
Payment Methods: All payments must be processed via our Secure Payment Gateway at dmcturquiallc.com or official designated banking channels of DMC, using major credit cards or encrypted bank wire transfers.
Pricing: All rates are quoted in USD (unless specified otherwise) and are net/non-commissionable. Prices are subject to change due to currency fluctuations or supplier price increases until final payment is received.
3. Cancellations and Refunds
All cancellations and refund requests are strictly governed by the Company’s Refund & Cancellation Policy, which is incorporated into this Agreement by reference. Cancellations must be submitted in writing and are subject to the following graduated schedule:
· 46+ days prior to arrival: Full refund minus a nominal administrative fee ($\le$5%).
· 45–31 days prior to arrival: 25% of the total package price is forfeited as a cancellation fee.
· 30–16 days prior to arrival: 50% of the total package price is forfeited as a cancellation fee.
15 days or fewer prior to arrival, or No-Show: 100% cancellation fee applies, subject to waiver if luxury suppliers issue fee-free waivers. The Client acknowledges having read and accepted said policy before making any payment.
4. Responsibility and Liability
Third-Party Suppliers: The Company acts as an elite intermediary and does not own or operate the airlines, hotels, or tour operators. The Company is not liable for any injury, loss, damage, or delay caused by third-party suppliers, and additional non-refundable costs imposed by them will be deducted from refunds.
Travel Documents: It is the Client’s sole responsibility to obtain and carry a valid passport, visa(s), and required health certificates.
Travel Insurance: It is a mandatory requirement that clients maintain comprehensive international travel insurance covering medical emergencies, cancellations, and luggage loss.
5. Chargebacks and Disputes
The Client agrees not to file a dispute (chargeback) with their credit card issuer for services that have been rendered or for cancellations that fall under the "Non-Refundable" or cancellation fee terms of this Agreement. Any dispute must first be addressed in writing to support@dmcturquiallc.com
6. Force Majeure
The Company shall not be liable for any failure or delay due to events beyond its reasonable control ("Acts of God"), including natural disasters, government-enforced travel bans, severe airspace closures, epidemics, pandemics, war, civil unrest, or sudden security emergencies. In such cases, clients are entitled to a full cash refund or a flexible open-date travel credit without penalty, excluding non-recoverable out-of-pocket supplier expenses actually incurred.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey and international commercial standards (with corporate alignment to the State of Wyoming, USA), and any legal disputes shall be submitted to the competent courts of Istanbul, Turkey.
8. Acceptance
By making a payment through the provided secure payment link, the Client confirms that they have read, understood, and agreed to the terms and conditions of this Service Agreement
